When a developer misses the promised handover date, buyers are not without options. We outline the contractual and statutory remedies available to off-plan purchasers in the UAE.
Buying off-plan remains one of the most popular routes onto the UAE property ladder, but handover delays are a recurring source of dispute. A buyer’s options depend on the sale and purchase agreement, the project’s registration status and the extent of the delay.
Start With the Sale and Purchase Agreement
Most agreements include a completion date together with a grace period, commonly six to twelve months. The contract will also set out the developer’s notification obligations and any compensation mechanism for late handover. Understanding these clauses is the first step in assessing your position.
Regulatory Protections
Off-plan projects must be registered with the competent authority in the relevant emirate, and purchase monies must be paid into a project escrow account rather than to the developer directly. These safeguards give buyers visibility over the project’s progress and protect instalments if the project is cancelled. Where a project is officially cancelled, refunds are administered through the escrow framework.
Remedies for Serious Delay
Depending on the circumstances, a buyer may claim compensation for the delay, suspend further instalments, or seek termination of the contract and a refund of amounts paid, whether through negotiation, the relevant regulator or court proceedings. The right strategy depends on the project’s actual completion percentage and the developer’s conduct, so an early legal assessment can prevent costly missteps.
